1. Introduction and Acceptance
These Terms of Service govern your use of grand galyk's website and banquet decoration services. By accessing our website or engaging our services, you agree to be bound by these terms.
grand galyk operates in Montreal, Quebec, Canada. Our services are subject to Canadian law and the laws of the Province of Quebec.
If you do not agree with these terms, please do not use our website or services.
2. Definitions
- "Service" refers to banquet decoration services provided by grand galyk
- "Client" means any individual or organization engaging our services
- "Event" refers to the celebration or function for which decoration services are provided
- "Proposal" means the written service description and pricing provided to clients
- "Agreement" refers to the contract formed when a proposal is accepted
- "We/Us/Our" refers to grand galyk
3. Service Terms and Booking
3.1 Service Eligibility
Our services are available to individuals 18 years of age or older who can enter into legally binding contracts under Canadian law.
3.2 Consultation and Proposals
Initial consultations help us understand your requirements. Following consultation, we provide a written proposal outlining services, pricing, and timeline. Proposals are valid for 30 days unless otherwise specified.
3.3 Booking Confirmation
Services are booked upon receipt of a signed agreement and deposit payment. Verbal agreements do not constitute confirmed bookings. We recommend booking 3-6 months in advance for optimal availability.
3.4 Information Accuracy
Clients must provide accurate information about venue, guest count, event timing, and specific requirements. Significant discrepancies may require proposal revision and pricing adjustment.
4. Payment Terms
4.1 Pricing and Deposits
Service pricing is specified in proposals and includes design, materials, delivery, installation, and breakdown. A non-refundable deposit of 50% is required to confirm booking. The deposit secures your event date and begins the planning process.
4.2 Payment Schedule
- 50% deposit due upon contract signing
- Remaining balance due 14 days before event date
- Additional services requested after booking are invoiced separately
- Late payments may result in service cancellation
4.3 Accepted Payment Methods
We accept bank transfers, certified checks, and major credit cards. All prices are in Canadian dollars (CAD) and include applicable taxes.
4.4 Additional Costs
Clients are responsible for venue access fees, parking charges, or special equipment rental not included in the original proposal. Significant changes to services may incur additional costs discussed and approved in advance.
5. Cancellation and Refund Policy
5.1 Client Cancellation
- More than 90 days before event: Deposit refund minus 25% administrative fee
- 60-90 days before event: 50% deposit refund
- 30-60 days before event: 25% deposit refund
- Less than 30 days before event: No refund available
Cancellations must be submitted in writing. The cancellation date is determined by when we receive written notice.
5.2 Postponement
Event postponements are treated as modifications rather than cancellations. Your deposit remains valid for rescheduling within 12 months. Postponements within 30 days of the event date may incur additional fees if specialized materials were ordered.
5.3 Force Majeure
If services cannot be provided due to circumstances beyond our control (severe weather, natural disasters, government restrictions, venue closure), we will work with clients to reschedule or provide partial refunds for undelivered services.
6. Service Delivery and Installation
6.1 Venue Access
Clients must ensure we have appropriate venue access during agreed installation windows. Delays due to venue restrictions or access issues may affect setup completion. We require a minimum of 4 hours access before event start time for standard installations.
6.2 Venue Compliance
All installations comply with venue regulations and safety standards. Clients must inform us of venue restrictions regarding hanging decorations, open flames, confetti, or other limitations. We are not liable for delays or modifications required due to undisclosed venue restrictions.
6.3 Design Variations
While we strive to match approved designs exactly, minor variations may occur due to material availability or venue-specific requirements. Significant changes require client approval. Colors may appear different under various lighting conditions.
6.4 Breakdown and Removal
We return after event conclusion to remove all decorative elements. Breakdown timing is coordinated with venue schedules. Clients should not remove or modify installations during events, as this may affect structural integrity.
7. Client Responsibilities
- Provide accurate venue information, floor plans, and access details
- Communicate any changes to guest count, timing, or requirements promptly
- Ensure venue staff are informed of our scheduled installation and breakdown times
- Inform us of any allergies, sensitivities, or special considerations
- Review and approve final design plans before event date
- Coordinate with other vendors to prevent scheduling conflicts
- Obtain necessary venue permissions for requested decorative elements
8. Liability and Disclaimers
8.1 Service Limitations
While we provide professional decoration services, we cannot control all factors affecting event success including venue conditions, weather (for outdoor elements), lighting variations, or other vendor performance. Our services are provided "as is" within the scope of decoration and design.
8.2 Limitation of Liability
Our total liability for any claims arising from our services is limited to the amount paid for those services. We are not liable for indirect, consequential, or incidental damages including but not limited to lost profits, event cancellation costs, or emotional distress.
8.3 Insurance
We maintain general liability insurance covering our operations. Clients are responsible for their own event insurance. We recommend clients consider event cancellation and liability insurance for their celebrations.
8.4 Damage to Property
We take care to prevent damage during installation and breakdown. However, clients are responsible for any pre-existing venue damage. We are not responsible for damage to client-provided items or decorations not installed by our team.
9. Intellectual Property
Design concepts, mockups, and creative work remain the intellectual property of grand galyk. Clients receive a license to use approved designs for their specific event. Designs may not be reproduced, shared with other decorators, or used for commercial purposes without written permission.
We retain the right to photograph completed installations for marketing purposes unless clients explicitly opt out.
10. Dispute Resolution
10.1 Initial Resolution
Concerns or complaints should be addressed to us directly first. We commit to responding to concerns within 5 business days and working toward reasonable resolution.
10.2 Mediation
If direct resolution fails, parties agree to attempt mediation before pursuing legal action. Mediation costs are shared equally unless otherwise agreed.
10.3 Governing Law and Jurisdiction
These terms are governed by the laws of Quebec and Canada. Disputes will be resolved in the courts of Montreal, Quebec. Both parties consent to the jurisdiction of these courts.
11. Modifications to Services
Changes to booked services must be requested in writing. Modifications made more than 30 days before the event can typically be accommodated. Changes within 30 days are subject to availability and may incur additional fees.
Significant increases in scope may require a revised proposal and additional payment before implementation.
12. Communication and Notifications
Official communications, including contract modifications, cancellations, or important notices, must be submitted in writing via email or registered mail.
We are not responsible for information conveyed through unofficial channels or verbal agreements that are not subsequently confirmed in writing.
13. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary. The remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms of Service, together with signed proposals and agreements, constitute the entire agreement between grand galyk and clients. No verbal agreements, promises, or representations made outside written documentation are binding.
15. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes become effective upon posting to our website with an updated "Last Updated" date.
Existing contracts remain subject to the terms in effect when the contract was signed. New bookings are subject to current terms.
